IMPORTANT NOTICE
In this decision, the Commissioner found that Part 9 of the Enterprise Act 2002 did not constitute a prohibition on disclosure in terms of section 26 of the Freedom of Information (Scotland) Act 2002.  The Council did not appeal the Commissioner's decision to the Court of Session. 

However, in a related case, the Court of Session found that Part 9 did constitute a prohibition on disclosure.  As a result, the Commissioner has decided not to enforce this decision.  The Court of Session's judgement can be viewed at .
